Terms & Conditions for Holiday Rentals

Last updated: September 2026

1. Purpose and Scope

These General Terms and Conditions of Sale and Rental, hereinafter referred to as the "T&Cs", govern bookings made directly with Chabanne Cottage, located in Chabanne, 87240 Saint-Sylvestre, France.

They apply to all bookings made on the website www.legitedechabanne.fr, as well as, where applicable, to bookings concluded directly by telephone or email.

Any booking implies the unreserved acceptance of these T&Cs by the client.

When a booking is made through a third-party platform such as Gîtes de France or Airbnb, the booking and cancellation conditions specific to that platform apply to the booking concerned.

Any offer or seasonal rental contract must be established in writing and specify, in particular, the price as well as a descriptive statement of the accommodation.

2. Identification of the Lessor

Hereinafter referred to as "the Lessor".

3. Description of the Accommodation

Chabanne Cottage is furnished tourist accommodation located in Saint-Sylvestre, Haute-Vienne.

The accommodation includes 5 bedrooms, 340 m² of living space, and a maximum capacity of 14 people.

The characteristics, equipment, photographs, and services of the accommodation are presented on the website and in the descriptive sheet provided to the client at the time of booking.

Certain services or equipment, particularly the outdoor swimming pool, may be subject to opening periods or weather conditions. The swimming pool is currently announced as open from late April to early October, subject to weather conditions.

4. Accommodation Capacity

The booking is concluded for the number of people declared at the time of the order, within the limit of the maximum capacity of 14 people.

The number of occupants may under no circumstances exceed this capacity without the prior written agreement of the Lessor.

The Lessor may refuse any additional person not planned at the time of booking.

Subletting, assignment of the booking to a third party, and the installation of tents, caravans, or other accommodation on the property are prohibited without prior written authorization.

5. Booking

The client must be of legal age and legally capable of entering into a contract.

When booking, the client selects, among other things:
- the dates of stay;
- the number of travelers;
- any additional services;
- if applicable, the presence of an animal.

Before final validation, a summary indicates the reserved accommodation, dates, price, and any extras.

The booking becomes final after:

payment of the requested deposit,
acceptance of these T&Cs,
and sending of a booking confirmation by email.

For an online booking, the client must be clearly informed that their validation implies an obligation to pay. This requirement is provided for in article L.221-14 of the Consumer Code.

6. Price

The applicable prices are those indicated to the client at the time of booking.

They are expressed in euros and include only the services explicitly mentioned in the booking summary.

Prices may vary according to:

the period of stay, its duration, the selected services, and any commercial offers in force.

The rates currently published by Chabanne Cottage vary, in particular, according to low, mid, high, and very high season.

The price indicated upon final validation of the booking constitutes the contractual price.

7. Services Included

Unless specific conditions are indicated at the time of booking, the stay includes, in particular:

- water;
- provision of the accommodation and its equipment;
- sheets;
- bathroom linen;
- towels for the swimming pool, jacuzzi, and sauna;
- basic electricity consumption currently corresponding to 20 kWh per day.

Any electricity consumption exceeding the included package may be invoiced according to the conditions and rates specified at the time of the stay.

8. Services and Extras

Certain services may be offered as extras, including:

- end-of-stay cleaning;
- beds made upon arrival;
- breakfasts;
- wood for the fireplace;
- additional energy consumption;
- other services offered at the time of booking.

The applicable price is that displayed when ordering.

As the prices of these options may change, the amounts displayed on the booking page take precedence over any previous information.

9. Tourist Tax

The tourist tax is not included in the price of the stay unless otherwise indicated.

It is due by persons liable to it in accordance with the local regulations applicable at the time of the stay.

Its amount is calculated according to the rate in force on the date of booking or stay.

10. Payment Methods

25% deposit upon booking.
Balance to be paid no later than 30 days before arrival.

For any booking made less than 30 days before arrival, the full amount of the stay is payable immediately.

This is also the current operating procedure provided by the Gîtes de France 2026 T&Cs.

Accepted payment methods are those offered at the time of booking.

In case of non-payment of the balance within the agreed deadline, the Lessor may consider the booking cancelled by the client after a formal notice has remained without effect.

11. Cancellation by the Client

Any cancellation must be addressed to the Lessor in writing, particularly by email.

To maintain a consistent policy with that applied to Gîtes de France bookings, I recommend:

More than 21 days before arrival: 25% of the stay amount remains due.

Between 20 and 8 days before arrival: 50% of the stay amount remains due.

Between 7 and 2 days before arrival: 75% of the stay amount remains due.

The day before, on the day of arrival, or in case of no-show: 100% of the stay amount remains due.

This scale corresponds to the principle currently applied by Gîtes de France for bookings without cancellation insurance.

Optional services not consumed may be refunded when they have not incurred any cost to the Lessor.

Cancellation insurance may be recommended to the client to cover certain unforeseen events.

12. Absence of Right of Withdrawal

Bookings for accommodation services provided on a specific date or during a specific period do not benefit from the 14-day withdrawal period applicable to many distance purchases.

This exception is expressly provided for in article L.221-28, 12° of the Consumer Code.

The booking is therefore firm upon confirmation, subject to the cancellation conditions provided above.

13. Cancellation by the Lessor

If the Lessor is unable to make the accommodation available to the client, they will inform the client as soon as possible.

Sums already paid for the stay will be fully refunded.

Where possible, the Lessor may also offer an alternative solution to the client.

These provisions apply without prejudice to other rights that the consumer may benefit from under applicable law.

14. Arrival and Departure

Arrival and departure times are specified in the booking confirmation or communicated to the client before their stay.

The client undertakes to respect these times or to notify the Lessor in case of delay.

Early arrival or late departure are only possible with the prior agreement of the Lessor.

15. Security Deposit

A security deposit of €1,500 is required for the stay.

Its payment or pre-authorization terms are communicated to the client before their arrival.

The security deposit is intended to cover, in particular:

- damage to the accommodation or its equipment;
- missing items;
- refurbishment costs;
- abnormally high cleaning costs;
- any consumption or service remaining due after the stay.

In the absence of damage or sums remaining due, the security deposit is returned after inspection of the accommodation.

Any retention must be justified.

16. Inventory and Damages

The client is requested to report any anomalies observed in the accommodation to the Lessor upon arrival.

Failing notification within a reasonable period, the accommodation and its equipment will be presumed to have been handed over in a state conforming to their description, subject to defects not immediately visible.

The client is responsible for damages caused by themselves, other occupants of the accommodation, or animals under their care.

17. Cleaning

The accommodation must be returned in a normal state of use.

When the client has not opted for a full cleaning package, they must comply with the cleaning obligations specified at the time of booking or in the internal regulations.

Any excessive dirt or intervention exceeding normally planned cleaning may result in additional justified invoicing.

The different cleaning packages and their prices are indicated on the booking page.

18. Animals

Animals are allowed only when their presence has been declared and accepted at the time of booking.

The client remains entirely responsible for the animal during their stay and must ensure that it does not cause any damage or nuisance.

Specific cleaning conditions may be applied during a stay with an animal when indicated at the time of booking.

19. Use of the Accommodation

The accommodation is intended for tourist accommodation use.

The client undertakes to use the premises peacefully and in accordance with their intended purpose.

Parties, receptions, events, or gatherings hosting people outside the booking require the prior written agreement of the Lessor.

The client undertakes to respect the neighborhood and avoid any noise or behavior likely to cause excessive nuisance.

20. Swimming Pool, Jacuzzi, Sauna, and Leisure Equipment

Users must comply with the safety and usage instructions displayed or communicated by the Lessor.

Children remain permanently under the supervision and responsibility of an adult, particularly near the swimming pool, jacuzzi, and other equipment that may present a risk.

The swimming pool's safety devices must under no circumstances be neutralized or misused.

As the outdoor swimming pool is subject to climatic conditions, its temperature and precise opening dates cannot be guaranteed independently of weather conditions.

21. Interruption of Stay and No-Show

Any late arrival, early departure, or interruption of the stay by the client does not entitle them to any refund for unused nights, except with the Lessor's special agreement, contrary legal provision, or potential coverage by cancellation insurance.

22. Insurance

The client is responsible for any damage they may cause during their stay.

It is their responsibility to check that they have civil liability insurance covering risks related to seasonal rental, particularly a guarantee known as "villégiature" (holiday rental).

A certificate may be requested before entering the premises.

23. Force Majeure

Neither party may be held responsible for a failure directly caused by an event presenting the legal characteristics of force majeure.

The party concerned must inform the other party as soon as possible.

The consequences for the booking will be determined according to the circumstances and applicable legal provisions.

24. Complaints

Any difficulty relating to the accommodation or services must be reported to the Lessor as soon as possible during the stay, to allow them to remedy it when possible.

Any complaint after the stay can be addressed to:

Chabanne Cottage
Chabanne
87240 Saint-Sylvestre

Email: philippe@legitedechabanne.fr

25. Personal Data

Personal data collected as part of a booking is used for, among other things:

managing requests and bookings, payment, organizing the stay, invoicing, and fulfilling the Lessor's legal obligations.

Detailed terms regarding the use of personal data are specified in the Privacy Policy accessible on the website.

26. Applicable Law and Disputes

These T&Cs are subject to French law.

In case of difficulty, the client and the Lessor will endeavor to seek an amicable solution first.

Failing that, the consumer may resort to consumer mediation and then refer the matter to the competent court in accordance with applicable legal rules.
